Halle Berry faces a new development in her custody dispute with Olivier Martinez after their teenage son, Maceo, reportedly asked to speak directly to a judge about allegations involving his mother.

The legal battle between Halle Berry and Olivier Martinez has taken an unexpected turn. The Oscar-winning actress, 60, is facing fresh controversy after her former husband revealed that their 13-year-old son, Maceo, reportedly wants to speak directly to a judge about an alleged confrontation with his mother. The development comes amid an increasingly tense custody dispute that has already resulted in temporary restrictions on Berry’s contact with her son.

According to court documents reported by People, the French actor believes Maceo should be allowed to give his account of an incident allegedly involving Berry on 26 September. Martinez argues that hearing directly from the teenager is essential to understanding what happened and ensuring that his concerns are taken seriously.

“He should have the opportunity to have his voice heard regarding what he experienced that night,” Martinez stated in the filing. The actor also expressed fears that preventing his son from testifying could discourage him from reporting potential problems in the future.

Martinez went further, claiming that Maceo feels his concerns about his mother have previously been dismissed. According to the actor, the teenager told him he had spoken to therapists about alleged physical incidents involving Berry but felt that his complaints had not received sufficient attention.

The latest allegations follow an emergency legal application filed by Martinez earlier this month. The actor requested a temporary restraining order against Halle Berry, alleging that Maceo had contacted him after an incident in which his mother had supposedly physically assaulted him and placed him in a chokehold.

However, Berry has firmly denied the accusations. Through her legal representatives, the actress described the claims as entirely without merit and deliberately misleading. Her team also accused Martinez of repeatedly violating court orders and questioned his conduct throughout their ongoing legal disagreements.

Despite the conflicting accounts, a judge granted a temporary restraining order covering Martinez and Maceo. The court nevertheless allowed Berry to maintain limited contact with her son, establishing a temporary visitation schedule on Mondays, Tuesdays, Saturdays and Sundays between 10am and 8pm.

Martinez has also requested sole custody of Maceo and additional restrictions on Berry’s access to the teenager. Among his demands was mandatory sobriety monitoring before, during or after visits. The judge rejected that request, however, citing insufficient information to justify such measures.

As the legal dispute continues, Berry’s eldest daughter, Nahla Aubry, 18, has publicly defended her mother through a declaration submitted to the court. Nahla, whose father is Canadian model Gabriel Aubry, described the actress as a loving and devoted parent and insisted that she had never witnessed abusive behaviour towards her younger brother.

“I never observed anything abusive about her parenting,” Nahla stated, explaining that her mother could be strict when necessary but remained supportive and deeply involved in her children’s lives.

The teenager also referred to a past confrontation between Martinez and her father, introducing another sensitive element into an already complicated family dispute.

Halle Berry and Olivier Martinez married in 2013, shortly before welcoming Maceo. They announced their separation in 2015, and their divorce was finalised the following year. Nevertheless, disagreements over their son’s upbringing have continued.
