Halle Berry secures a legal victory as a restraining order is lifted, but Olivier Martinez retains primary physical custody of their 13-year-old son, Maceo.

The legal dispute between Halle Berry and her former husband Olivier Martinez has entered another complicated chapter. Following a court hearing in Los Angeles, a judge has reportedly dissolved the temporary restraining order against the Oscar-winning actress, although Martinez will retain primary physical custody of their 13-year-old son, Maceo.

The decision represents a mixed outcome for Berry, who has been involved in an ongoing custody dispute with the French actor. The proceedings intensified earlier this month when Martinez obtained a temporary restraining order after making allegations of physical abuse involving their son.

Halle Berry has consistently denied the accusations, with her legal representatives previously describing them as entirely without merit and deliberately misleading.

According to reports from TMZ, the latest hearing resulted in the dissolution of the restraining order, a development welcomed by the actress’s legal team.

“We are extremely pleased that the Court has dissolved the TRO,” Berry’s attorney, Marina Beck, told Page Six.

She added that the actress remains determined to prioritise the wellbeing and best interests of her family as the proceedings continue.

However, the ruling did not deliver the custody arrangement Berry had reportedly requested.

According to Patrick Baghdaserians, Olivier Martinez’s lawyer, Berry’s legal team sought to restore an equal 50/50 physical custody arrangement, but the judge rejected that request.

Martinez, who had already been granted temporary primary physical custody ahead of the October hearing, will therefore maintain that arrangement for the time being. His lawyer reportedly described the decision as a significant victory.

Los Angeles Superior Court Judge Shelley L. Kaufman also ruled that Berry cannot currently have overnight visits with her son, according to NBC Los Angeles.

Despite these restrictions, representatives for the actress have clarified that Berry continues to share legal custody of Maceo and reportedly retains the deciding authority if the parents cannot agree on certain matters.

The distinction between physical and legal custody is particularly important in this case, as it means that the current living arrangements do not necessarily remove Berry’s involvement in major decisions concerning her son’s upbringing.

The situation is also far from resolved. According to TMZ, the court is expected to reconsider custody arrangements in November, potentially opening the door to further changes.
